Agreement to these terms
By creating an account, accepting an invitation, accessing Maxlona, or installing or using Maxlona software, you agree to this End-User License Agreement. If you use Maxlona for an organization, you represent that you have authority to bind that organization, and “you” includes that organization. If you do not agree, do not use the service or software.
Maxlona is a privately held software company. References to “Maxlona,” “we,” “us,” and “our” mean the provider of the Maxlona service.
Limited right to use Maxlona
Subject to this agreement and any applicable order or subscription, Maxlona grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the service, documentation, and client software for your internal business purposes during the applicable trial or subscription term.
You may not sell, rent, sublicense, redistribute, copy, modify, reverse engineer, decompile, disassemble, or attempt to derive source code from proprietary Maxlona software except where applicable law expressly permits it. You may not bypass security or usage controls, probe for vulnerabilities without written authorization, use the service to violate law or third-party rights, interfere with other users, or use Maxlona to build or benchmark a competing product for publication without written permission.
Open-source components and separately distributed SDKs may be governed by license notices supplied with those components. Those notices control if they conflict with this section for the relevant component.
Your account responsibilities
You must provide accurate account information, protect credentials and API keys, and promptly notify us of suspected unauthorized access. Organization administrators control membership, roles, single sign-on settings, and access to organization data. You are responsible for activity performed through accounts and credentials under your control and for ensuring that your users comply with this agreement.
You retain ownership of your data
You retain your rights in data and configuration submitted to Maxlona. You grant Maxlona the rights necessary to host, process, transmit, back up, and display that data to operate, secure, support, and improve the service. You represent that you have the necessary rights and lawful basis to provide the data and instructions you submit.
Our Privacy Policy explains how we handle personal information. You are responsible for choosing appropriate feature-flag context data and should avoid sending secrets or unnecessary sensitive information in evaluation payloads.
Plan terms apply
Trials, plan features, usage limits, fees, renewal, cancellation, and taxes are governed by the terms shown when you subscribe or in an applicable written order. Trial functionality may expire or become unavailable unless you purchase an eligible subscription. We may update the service and this agreement. Material changes apply prospectively after notice where required by law.
Service provided as available
To the maximum extent permitted by law, Maxlona is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation or that every configuration will produce a particular business result.
To the maximum extent permitted by law, Maxlona will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data. Maxlona's aggregate liability arising from the service will not exceed the amount you paid to Maxlona for the service during the twelve months before the event giving rise to the claim. These limitations do not apply where prohibited by law.
Ending access
You may stop using Maxlona and cancel according to your subscription terms. We may suspend or terminate access for material breach, security risk, unlawful use, nonpayment, or when required by law. Upon termination, the license ends and you must stop using the service and proprietary software. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, and accrued payment obligations—will survive.
Complete agreement
This agreement, the Privacy Policy, applicable subscription or order terms, and incorporated notices form the agreement governing your use of Maxlona. If any provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign this agreement without our consent; Maxlona may assign it in connection with a reorganization, financing, merger, acquisition, or sale of assets.
